According to technology media outlet MacObserver, OpenAI recently filed a motion with the court seeking the complete dismissal of Apple’s trade secret theft lawsuit.
OpenAI said Apple’s allegations lack substantive evidence and are based more on speculation than conclusive proof.
ITHome learned that the lawsuit stems from former Apple employees and current OpenAI employees Chang Liu and Tang Tan. Apple accused the two of stealing trade secrets and teaching newly hired OpenAI employees how to circumvent Apple’s security checks.
However, the two defendants said they retained documents from their time at Apple to help new OpenAI employees comply with security regulations, not to obtain or disseminate Apple’s trade secrets.
OpenAI’s legal team also argued that Apple was effectively asking the judge to speculate about what had happened, without providing conclusive evidence. Apple had also failed to produce information showing that the former employees misused confidential information, or clear evidence that it suffered financial losses as a result of the alleged leak.
With OpenAI’s filing of its latest motion to dismiss, both sides have set out their core positions. The court will hold a hearing on October 1 to consider OpenAI’s motion to dismiss.
If the court ultimately grants OpenAI’s request, the lawsuit could be dismissed permanently, preventing Apple from bringing the same case before the court again.
